On this 17th day of September, 1890 personally appeared Mary R. Lolley , who, being duly sworn, declares that she is the lawful widow of John W. Lolley, deceased; and that he died on the 23 day of June, 1890; that he had been granted a pension by Certificate No. 283444 which is herewith returned; that he had been paid the pension by the Pension Agent at Topeka up to the 4th day of June, 1890; after which date he had not been employed or paid in the Army, Navy, or Marine service of the United States; that she was married to the said John W. Lolley on the 28th day of October, 1854 at Elkhorn, in the State of Wisconsin; that her name before marriage was Mary R. Hartson; that she had not been previously married; that her husband had not been previously married; that she hereby makes application for the pension which had accrued on aforesaid certificate to the date of death; and that her residence is City of Wheaton, county of Pottawatomie, Date of Kansas, and her Post-office address is Wheaton

Lolley sign her name to the foregoing declaration; that they know her to be the lawful widow of John W. Lolley, who died on the 23 day of June, 1890; and that their means of knowledge that said parties were husband and wife, and that the husband died on said date, are as follows:

Declaration of Original Pension of a Widow - Child or Children under Sixteen Years of age Surviving

State of Kansas, County of Pottawatomie

On this 17th day of September, A.D. one thousand eight hundred and ninety personally appeared before me Notary Public the same being a court of record within and for the county and State aforesaid, Mary R. Lolley agreed 53 years, who, being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Acts of Congress granting pension to widows: That she is the widow of John W. Lolley who at Oxford, Wisconsin on the 29th day of February, A.D. 1864 in company H. 36th Regt. Wisconsin in the war of 1861 to 1865 who sun stroke Aug 14, 1864 liver complaint and chronic diarrhea on the 14th day August, A.D. 1864 who bore at the time of his death and rank of Private in the late War that she was married under the name of Mary R. Hartson to said John W. Lolley on the 28th day of October, A. D. 1854 by Esquire Stow at Elk Horn, Wisconsin, there being no legal barrier to such marriage; that neither she nor her husband had been previously married that she has to the present date remained his widow; that the following are the names and dates of birth of all his legitimate children yet surviving who were under sixteen years of age at the father's death, to wit:

That she has not appointed an attorney to prosecute her claim, that her residence is Sherman Township and that her post office is Wheaton, Kansas.

Kessler, residing at Wheaton and George Grice residing at Wheaton, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw Mary R. Lolley, the claimant, sign her name to the foregoing declaration;that they have every reason to believe, from the appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; and that they have no interest in the prosecution of this claim.

R. L. Douring being duly sworn on his oath says that he was personally acquainted with John W. Lolley and Mrs. Mary R. Lolley for eighteen years from the 23rd June A.D. 1890, and on the 24th day of June A.D. 1890 I preached his funeral and witnessed his burial the same day. I further state that John W. Lolley and Mrs. Mary R. Lolley lived together as man and wife all the time from the first time I became acquainted with them until his death.

Isaac Hartson and Lydia Hartson being each severally sworn on their oaths depose and say that they were each present at the marriage of John W. Lolley and Mary R. Hartson in Elkhorn, Wisconsin on or about the 28th day of October of 1854.

Further that from personal knowledge each of them say that the said John W. Lolley and Mary R. Hartson have lived together as husband and wife continually since the above date October 28th, 1854 until the death of the husband John W. Lolley in June 1890.

Mary S. Sherman being duly sworn says her post office address is Wheaton, Kansas age 70 years and by occupation midwife. I attended Mary R. Lolley, widow of John Lolley deceased, when her son Elmer Lolley was born. His age as follows: born July 30, 1876.

General Affidavit

In the matter of Widow's Pension Claim No. 452555 of Mary R. Lolley widow of John W. Lolley Co. H. 36 Reg. Wisconsin Inf. Vol.

On this 9th day of July A.D. 1891, personally appeared before me a notary public in and for the aforesaid County, duly authorized to administer oaths Serena Plummer age 49 years a resident of Wheaton, in the County of Pottawatomie, and State of Kansas whose Post Office address is Wheaton and Margaret Boardman, aged 61 years, a resident of Wheaton, in the County of Pottawatomie and state of Kansas, whose Post Office address is Wheaton well known to be reputable and entitled to credit, and who, being duly sworn, declared in relations to aforesaid case, as follows:

That we are neighbors of Mary R. Lolley who is the widow of John W. Lolley deceased on whose account she applies for a pension. And that for the past 19 years we have been well acquainted with said Mary R. Lolley that from our frequent intercourse and conversation and from other circumstances we have reason to believe and we do believe that said widow has not remarried since the death of the above mentioned John W. Lolley. Further we say that if she had remarried we have reason to believe the at we should have known it. Affiants further state that they were neighbors of Mary R. Lolley and visited her during her confinement July 30, 1876 when said Mary R. Lolley was delivered of a male child afterward named Elmer and that Mrs. Mary Sherman was the midwife on that occasion. Affiants are able to remember the date of the birth of said Elmer by personal recollection and by having access to the family record of said Mary R. Lolley where the name and birth of said minor child is now a part of said record and that said minor child is still living.

Affiants further declare that they have no interest in said case and are not concerned in its prosecution.

Act of June 27, 1890
Declaration for Widow's Pension

State of Kansas, County of Pottawatomie

On this 29th day of October, A.D. one thousand eight hundred and ninety-one, personally appeared before me, a notary public of the court, the same being within and for the county and State aforesaid Mary R. Lolley, aged 54 years, a resident of near Wheaton, county of Pottawatomie, State of Kansas, who, being duly sworn according to law, declares that she is the widow of John W. Lolley, who enlisted under the name of John W. Lolley on the 29th day of February A.D. 1864 in Co. H. 36th Reg. Wisconsin Inf. Vol. and served at least ninety days in the late War of the Rebellion, who was honorably discharged July 12, 1865 and died near Wheaton, Kansas on June 23, 1890.

That she was married under the name of Mary R. Hartson, to said John W. Lolley, on the 28th day of October 1854 by Esq. Stow, at Elkhorn, Wisconsin, Walworth Co. there being no legal barrier to said marriage. There was no former marriage on her part or that of John W. Lolley and she has not remarried since the death of the said John W. Lolley.

That she is without other means of support than her daily labor. That names and dates of birth of all the children now living under sixteen years of age of the soldier are as follows;

That she has heretofore applied for pension and the number of her former application is 452.555. That her husband was drawing pension under cert. no. 283.444. That she makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of June 27, 1890.

She hereby appoints with full power of substitution and revocation, Edward T. McFarland of Havensville, State of Kansas, her true and lawful attorney to prosecute her claim, the fee to be Ten Dollars as prescribed by law. That her post-office address is Wheaton, County of Pottawatomie, State of Kansas.
