James H. Lolley Deed

John Lolley has moved to Warrensburg, Johnson, Missouri and finally disposes of the land in Ontario, Wayne, New York that his mother and siblings inherited from their father William upon his death in 1848.

This Indenture made the fifth day of February in the year of our Lord one thousand eight hundred and sixty six Between James H. Lolly of the town of Warrensburg county of Johnson and State of Missouri of the first part and John Denny of the town of Williamson County of Wayne and State of New York of the second part.

Witnesseth, that the said party of the first part in consideration of the sum of nine hundred dollars [$900.00] lawful money to him in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged has bargained, sold, remised, and Quit Claimed and By these Presents does bargain, sell, remise, and Quit Claim unto the said party of the second part and to his heirs and assigns forever, all that parcel of land situate in the town of Ontario county of Wayne State of New York Known and distinguished as the north part of lot forty three in said town Bounded as follows.

Beginning at the northeast corner of said lot thence south four degrees west forty five rods, thence north eighty six degrees west fifty rods, thence north four degrees east forty five rods, thence south eight six degrees east fifty rods to the place of beginning containing fourteen acres and ten rods as surveyed by E. Davis Oct. 28th, 1850 be the same more or less.

Together with all and singular the hereditaments and appurtenances thereto belonging or in any wise appertaining and the revision and reversions, remainder and remainders, rents, issues and profits thereof and all the estate, right, title, and interest, claim, and demand whatsoever of the said party of the first part either in law or equity, of, in and to the above bargained premises with the said hereditaments and appurtenances to Have and to Hold the said above described premises to the said party of the second part, his heirs and assigns, to the sole and only proper benefit and behoof of the said party of the second part his heirs and assigns forever. In witness whereof the party for the first part has hereunto set his hand and seal the day and year first above written.

State of Missouri, Johnson County SS: On this tenth day of February in the year one thousand eight hundred and sixty six before me the subscriber personally appeared James H. Lolley to me know to be the same person described in and who executed the within instrument and acknowledged that he executed the same. In testimony whereof I have herewith subscribed my name and affixed the seal of said court at Office in Warrensburg this 10th day of February A.D. 1866.

State of Missouri, County of Johnson SS: Be it remembered that James H. Lolley who is personally know to the undersigned a Justice of the Peace within and for said County to be the person whose name is subscribed to the within deed as a party thereto this day appeared before me and acknowledged that he executed and delivered as his voluntary act and deed for the purposes therein contained given under my hand this 4th day of June A.D. 1866.
