This is the will of Frederick Overly of Springfield Township Ross County Ohio. Frederick was the grandfather of Joseph Tharp. Frederick added the codicil to his will three days after Joseph's mother, Elizabeth Overly, died.
To son Geo O farm I now live on called home place in Spfd twp. 276a exc 82a of NE part S5 T8 R21. To son John tract adj. home place in Spf T. 118a being part tract purch by bro. Martin O. together wi 82a. NE above named. desire road to be laid bet two divis land of son Geo & John to Chill Rd. Dau Elizabeth Overly now Elizabeth Tharp 158a in Green T. SE 1/4 Sec 33 T9 R21.
Dau Polly now Polly Smidley 160a in Harrison T SW 1/4 Sec 9 T9 R20 she now lives Rd bet dau Margaret Wheeland & Polly Rd to Adelphi Rd. Dau Susanna Jennings 160a Colerain NE 1/4 S2 T10 R20. Dau Margaret Wheeland 240a Harrison T NE 1/4 Sec 8 T9 R20 also E ½ NW 1/4 Sec 8 T9 R20.

Codicil 5 Aug 1843 - No tracts to be sold until youngest surv heir of either my heirs aforesaid shall arrive 21y then may dispose. When heirs of s. Geo arrive 21y they may sell.
