Will of Hugh Franklin McCarter
of Camas County, Idaho

September 26, 1921

IN THE PROBATE COURT OF CAMAS COUNTY, STATE OF IDAHO
LAST WILL AND TESTAMENT OF HUGH McCARTER

IN THE NAME OF GOD, AMEN. I, Hugh F. McCarter, of Corral, Camas County, Idaho, of the age of seventy-five years, and being of sound and disposing mind and memory, and not acting under duress, menace, fraud, or undue influence of any person whatever, do make, publish, and declare this my Last Will and Testament.

First, I direct that my body be decently buried with proper regard to my station and condition in life, and the circumstances of my estate, and that a suitable monument be erected over my grave with usual inscription thereon.

Secondly, I direct that my executor hereinafter named, as soon as he has sufficient funds in his hands, is to pay my funeral expenses, the expense of my last sickness, and my lawful debts.

Thirdly, I give and bequeath to my son, Orla J. McCarter, one dollar, to my son Claude C. McCarter, one dollar, to my daughter Lala E. Harness nee McCarter, one dollar, to my son Earl R. McCarter, one dollar, to H.R. McCarter, one dollar.

Fourthly, I give, devise and bequeath all the rest, residue and remainder of all my real and personal estate, goods and chattels, of whatever kind or nature, owned by me at my death as follows:

The east eighty of my ranch and the north forty acres of the west eighty of my ranch to my son William S. McCarter; the south one half of the west eighty of my ranch to my daughters, Sallie McCarter and Kate R. McCarter.

Fifthly, I give and bequeath to my grandson, James McCarter, son of H.R. McCarter, one-hundred dollars ($100.00); and to my grand daughters, Mildred McCarter and Mary McCarter, daughters of H.R. McCarter, each, I give and bequeath fifty dollars ($50.00).

Sixthly, I give, devise, and bequeath the real and personal property as set forth subject to the condition that the beneficiaries therein named or their heirs are forever barred from selling or conveying any of the above described property to Henry R. McCarter or Claude C. McCarter.

Lastly, I hereby nominate and appoint my son, Orla J. McCarter, Executor of this, my last Will and Testament, without the necessity of giving any bonds whatsoever, and I hereby revoke all former wills by me made.

The foregoing instrument, consisting of one page and part of a second page, was at the date hereof, by said Hugh F. McCarter, signed and sealed and published as and declared to be his last will and testament, in the presence of us, who, at his request have subscribed our names as witnesses thereto.
